Bill Risner attorney for Plaintiff sought the hearing before Judge Miller to ask him to "amend his findings of fact and conclusions of law" in his December 2007 ruling - telling the judge he erred in concluding that security concerns raised by the county should be considered in whether the Democrats and other political parties on the ballot should be granted access to all of the county's electronic elections databases. Judge Miller in December ordered the county to give the political parties access to the primary and general election of 2006, but not the Regional Transportation Authority election. Miller ordered the Board of Supervisors to give the parties two database files, but not the 310 databases for the elections in 06. However, Miller said the Plaintiff could come back to court and request others after it had the opportunity to study the MDB files for the 06 elections and to address the current and future security concerns raised by the defendant. Why would the county continue with its argument when they have nothing as proof to backup their defense? Pima County Chief Attorney Christopher Straub told Judge Miller that the Democrats' lawsuit has already begun eroding public confidence in the integrity of elections. Straub accused Risner and party officials of using the lawsuit in "making slanderous allegations" about the honesty of county elections and county leadership regarding the RTA election. The Democratic Party again is asking for all the county's elections databases in the county's possession - dating back to 1998, which was secured and kept in the court custody. As to the RTA election much has been found wrong, further analyses will be done after a special designed computer software tool is built to analyze the Diebold databases which work in Microsoft Access. Such a tool would be available to all political parties acting as official observers in elections to see whether manipulation have occurred and check for vulnerabilities, anomalies or signs of tampering in county's Diebold-GEMS voting system.
